Councillor Code of Conduct Panel Findings – Cr Houlihan

On 19 December 2019 the independent Councillor Code of Conduct Panel handed down its decision regarding a number of conduct complaints made against Cr Tom Houlihan.

Pursuant to section 81J(1)(b) of the Local Government Act 1989 the Panel makes a finding of serious misconduct against Cr Tom Houlihan of West Wimmera Shire.

As a result of this, pursuant to section 81J(2A)(b)(iv) of the Local Government Act 1989 the panel makes an order to suspend Cr Houlihan from all duties as a Councillor for a period of two (2) months effective form the date of the decision.

In addition to this, pursuant to section 81(J)(1)(a) of the Local Government Act 1989 the Panel makes a finding of misconduct against Cr Tom Houlihan of West Wimmera Shire.

Accordingly pursuant to section 81J(2)© of the Local Government Act 1989 the Panel makes an order that Cr Houlihan take a leave of absence form duties as a Councillor for a period of two (2) months to be served concurrently with the term of suspension.

Effective from 20 December 2019 Councillor Houlihan will not represent Council at any meetings, committees or community events and will not participate in any Council Meetings or decision making for a period of two (2) months.

During his period Councillor Houlihan will not engage with the public as a Councillor and will not be contactable via his Council mobile telephone number or Council email address.
